What Counts as Drug Distribution Under New Jersey Law

Under N.J.S.A. 2C:35-5, it is unlawful to manufacture, distribute, or dispense a controlled dangerous substance (CDS), or to possess one with intent to distribute. Distribution includes any actual or constructive transfer of a CDS from one person to another, and no exchange of money is required. Handing someone a controlled substance, even once and without payment, can satisfy this element.

New Jersey classifies controlled substances into five schedules based on their potential for abuse and accepted medical use, from Schedule I (high abuse potential, no accepted medical use) through Schedule V. The degree of a drug distribution charge depends on which drug is involved and the quantity found under the defendant’s control, ranging from fourth degree at the lower end to first degree for large quantities of heroin, cocaine, or other serious controlled substances.

Penalties by Degree of Crime

The difference between a third-degree and a first-degree indictable offense is measured in decades. Here is how New Jersey structures distribution penalties:

  • First degree (such as 5 ounces or more of heroin or cocaine): 10 to 20 years in prison, fines up to $500,000
  • Second degree: 5 to 10 years in prison, fines up to $150,000
  • Third degree: 3 to 5 years in prison, fines up to $75,000
  • Fourth degree: Up to 18 months in prison, fines up to $10,000

Most distribution offenses carry a mandatory minimum parole ineligibility period of one-third to one-half of the sentence imposed. Certain circumstances push penalties higher. Distributing within 1,000 feet of school property or within 500 feet of a public park, public housing, or library can increase the degree of the charge or add a mandatory minimum. Distributing to a person under 18 or a pregnant person can double both the prison term and the parole ineligibility period.

What the Prosecution Must Prove

Drug distribution arrests move fast, but convictions require the state to meet a specific burden of proof. Prosecutors must establish that the substance is in fact a controlled dangerous substance, that the defendant acted knowingly or purposely, and that the defendant manufactured, distributed, dispensed, or possessed the drug with intent to distribute. Each of those elements is a potential point of challenge.
